These terms apply when you download or play a game published by PenD Games. By installing one of our games, you accept them.

Your licence to play

We give you a personal, non-exclusive, non-transferable licence to install and play our games on devices you control, for your own entertainment. You may not copy, sell, rent, decompile, or modify a game, strip out its content, or redistribute it, except where the law gives you that right regardless of what this document says.

What belongs to whom

The games, their artwork, sound, code, and the PenD Games name and logo belong to us. Photos you add through a game's photo mode remain yours; they stay on your device and we make no claim to them.

Fair use of the games

Please don't use cheats, modified clients, or automation to manipulate scores, and don't attempt to interfere with the game's operation or with other players' devices.

Purchases and ads

Any purchases are made through Google Play and are subject to Google's terms and refund policy. Our games are supported by advertising; we choose the ad network but not which individual ads you see, and we are not responsible for the content of third-party ads or the sites they lead to.

Availability

Our games are provided as they are. We may update, change, or withdraw a game or any of its features at any time, and a game may not work on every device or every version of Android. We don't promise the games will be free of faults or available without interruption.

Liability

To the extent the law allows, PenD Games is not liable for lost progress or scores, for loss of data, or for any indirect or consequential loss arising from your use of our games. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot legally be limited. If you are a consumer, your statutory rights are unaffected.

Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you live elsewhere in the UK or in the EEA, you keep the protection of any mandatory consumer law in your country of residence.

Changes

We may revise these terms. The current version always lives on this page, with the date it took effect at the top.
